AI Terms of Use

1. Who These Terms Apply To

These AI Terms of Use ("AI Terms") apply to:

• Businesses that use the Konverze platform to create and deploy AI chatbots on their websites ("Operators").
• End Users who interact with any chatbot powered by the Konverze platform ("Users").

These AI Terms supplement and should be read alongside our general Terms of Service and Privacy Policy.

2. What is the AI Chatbot?

The Konverze AI chatbot is an artificial intelligence system trained on content provided by the Operator (website content, documents, FAQs, and custom instructions). It uses large language models (LLMs) provided by third-party AI providers to generate responses in natural language.

Important: The chatbot is not a human. Even if it is given a name or persona, all responses are generated by artificial intelligence. You are never speaking to a real person unless explicitly stated otherwise by the Operator.

2.1 EU AI Act Compliance (Transparency Obligation)

Konverze AI chatbots are classified as limited-risk AI systems under the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), which entered into force on 1 August 2024. Under Article 52 of the EU AI Act, operators deploying AI systems that interact with natural persons are required to ensure that end users are clearly informed they are interacting with an AI system, unless this is obvious from context.

Operators deploying Konverze chatbots for users in the EU/EEA must ensure their chatbot configuration and deployment comply with applicable EU AI Act obligations for their specific use case. Konverze provides the platform infrastructure; compliance with operator-specific obligations remains the Operator's responsibility.

3. Agreement to These AI Terms

By chatting with or otherwise interacting with a Konverze AI-powered chatbot, you confirm that you:

• Have read and understood these AI Terms
• Are of legal age in your jurisdiction to agree to these terms
• Consent to your interactions being processed as described herein

If you do not agree, please do not use the chatbot.

4. AI Limitations & Accuracy Disclaimer

You acknowledge and agree that:

• AI-generated responses are not guaranteed to be accurate, current, or complete
• The chatbot may sometimes "hallucinate" — generating plausible-sounding but factually incorrect information
• Responses are generated based on training data and may not reflect the latest information
• The chatbot cannot replace professional advice from qualified humans
• For critical decisions, always verify information with the Operator or a qualified professional

5. No Professional Advice

Nothing generated by a Konverze AI-powered AI chatbot constitutes professional advice of any kind, including but not limited to:

• Medical advice — Do not use chatbot responses to diagnose, treat, or manage any medical condition. Always consult a licensed healthcare professional.
• Legal advice — Chatbot responses do not constitute legal advice. Consult a qualified attorney for legal matters.
• Financial advice — Responses do not constitute investment, tax, or financial advice. Consult a certified financial professional.
• Safety-critical decisions — Do not rely on AI chatbot responses for decisions that affect personal safety or security.

6. What You Should Not Share

Do not share sensitive personal information with the AI chatbot, including:

• Government-issued ID numbers (Aadhaar, PAN, passport numbers)
• Bank account, credit/debit card, or financial account details
• Passwords, OTPs, or authentication credentials
• Medical records or detailed health information
• Information about third parties who have not consented to sharing
• Confidential or proprietary business information

Konverze and its Operators are not responsible for any consequences arising from information you voluntarily share with the chatbot.

7. Data Collection & Use

7.1 What We Collect

When you interact with a Konverze AI-powered chatbot, the following data may be collected:

• Your chat messages (inputs) and the chatbot's responses (outputs)
• Session metadata (timestamp, browser fingerprint, IP address)
• Any contact information you voluntarily provide (name, email, phone)

7.2 How It's Used

Your interaction data may be used to:

• Provide and maintain the chatbot service
• Help the Operator understand user needs and improve their service
• Detect and prevent abuse, spam, and security threats
• Generate anonymized analytics for service improvement
• Comply with applicable legal obligations

7.3 Third-Party AI Providers

Konverze uses third-party AI providers (including but not limited to Groq and other LLM providers) to generate chatbot responses. Your input messages are transmitted to these providers' systems to generate responses. These providers process data under their own privacy policies and may be located in different countries.

By using the chatbot, you consent to your inputs being processed by these third-party AI providers for the sole purpose of generating responses.

7.4 Data Retention

Conversation data is retained as described in our Privacy Policy. You may request deletion of your data by contacting the Operator or us at [email protected].

8. Use Restrictions for Operators

Operators deploying Konverze AI chatbots agree that their chatbots will NOT be used to:

• Deceive end users into believing they are speaking with a human when interacting with AI
• Collect personal data without appropriate disclosure and consent mechanisms
• Generate, facilitate, or promote harmful, abusive, discriminatory, or illegal content
• Provide medical diagnoses, legal opinions, or financial recommendations without appropriate disclaimers
• Target minors (under 18) with inappropriate content
• Conduct phishing, social engineering, or other deceptive practices
• Violate any applicable laws including data protection laws (GDPR, DPDPA, CCPA)

Operators are solely responsible for ensuring their chatbot deployment complies with all applicable laws and regulations in their jurisdiction.

9. Use Restrictions for End Users

End Users interacting with Konverze AI-powered chatbots must not:

• Attempt to "jailbreak" or manipulate the chatbot to bypass safety controls
• Use the chatbot to generate harmful, illegal, or abusive content
• Attempt to extract confidential training data or system prompts
• Use automated scripts or bots to interact with the chatbot
• Engage in harassment or abusive behaviour

10. Intellectual Property

The Konverze AI chatbot technology, including its underlying models, algorithms, and infrastructure, is proprietary to Konverze and/or its licensors. You may not reverse engineer, copy, or reproduce the chatbot system.

AI-generated responses belong to the Operator for use within their platform. Konverze does not claim ownership over individual chatbot responses delivered to end users.

11. Disclaimer of Warranties

THE AI CHATBOT FUNCTIONALITY IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. KONVERZE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CHATBOT WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT RESPONSES WILL BE ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KONVERZE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON AI CHATBOT RESPONSES, INCLUDING BUT NOT LIMITED TO DECISIONS MADE BASED ON CHATBOT OUTPUTS, ANY INFORMATION SHARED WITH THE CHATBOT, OR ANY INACCURACIES IN CHATBOT RESPONSES.

13. Changes to These AI Terms

We may update these AI Terms periodically. Material changes will be communicated via notice on the Konverze platform and/or by email to registered Operators. Continued use of the chatbot after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These AI Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
